Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and HowTheyGotUsers ("HowTheyGotUsers", "we", "us" or "our"), the operator of the website at howtheygotusers.com and the related subscription service (together, the "Service"). They govern your access to and use of the Service. Please read them carefully. If you do not agree to these Terms, do not access or use the Service.
1. Acceptance of these Terms
By creating an account, signing in, subscribing, or otherwise accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy and Refund Policy, each of which is incorporated into these Terms by reference. If you are using the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms, in which case "you" refers to that organization.
If you do not agree with any part of these Terms, your only remedy is to stop using the Service.
2. Eligibility
The Service is intended for business and professional use by adults. To use the Service you must be at least 16 years of age, and you must be of the age of majority in your country, province or state of residence to enter into a binding contract. If you are between 16 and the age of majority where you live, you may only use the Service with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms.
You may not use the Service if you are barred from doing so under the laws of your jurisdiction or any applicable jurisdiction, or if you are subject to sanctions or located in an embargoed territory. By using the Service you represent that you meet these eligibility requirements.
3. Definitions
- "Service" means the HowTheyGotUsers website, the searchable library, and all related features, content and functionality we make available.
- "Content" means all material made available through the Service, including our written summaries, descriptions, categorizations, tags, compilations and other materials.
- "Tactic" means an individual entry in our library: our own original, plain-English write-up summarizing a user-acquisition or marketing technique discussed in a public source, together with a link to that source.
- "Subscription" means a paid, recurring plan that grants access to the Service for a billing period.
- "Dodo Payments" means our third-party payment provider acting as the merchant of record for your purchases, as described in Section 6.
- "Account" means the personal account you create to access the Service.
4. The Service and your limited license to access
The Service is a paid reference library of approximately 3,000+ real user-acquisition and marketing tactics that founders have used to get their first users. Each Tactic is our own original write-up summarizing techniques discussed in public founder interviews, podcasts and written sources, and links out to the original public source. The Service is an educational and reference product.
Subject to your compliance with these Terms and your payment of all applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to access and view the Content through the Service for your own internal business and personal reference purposes only. This license does not transfer any ownership to you, and all rights not expressly granted are reserved by us. Your access rights are conditioned on your continued compliance with these Terms.
5. Accounts, sign-in and security
To use the Service you must create an Account. We use Supabase to provide authentication, and you sign in using Google sign-in or an email magic link. We do not store passwords. You are responsible for maintaining control of the email account and sign-in method associated with your Account.
Your Account is for one person only. You agree that:
- An Account may be used by a single individual; one license equals one person.
- You will not share, sell, rent, lend, transfer or otherwise make your Account, sign-in link or access available to anyone else.
- You will provide accurate information and keep your contact email current.
- You are responsible for all activity that occurs under your Account.
- You will notify us promptly at our contact page if you suspect any unauthorized use of your Account.
We may suspend or terminate Accounts that we reasonably believe are shared among multiple people, used by an organization in excess of the licenses purchased, or otherwise used in breach of these Terms.
6. Pricing and billing
The Service is offered as a one-time purchase of US$29 for lifetime access to the Content, including updates we add over time. It is not a subscription: there is no recurring charge and no auto-renewal. There is no free tier. Prices are stated exclusive of taxes unless otherwise shown at checkout; applicable taxes or VAT will be calculated and added by the merchant of record.
Merchant of record. Payments are processed by Dodo Payments, which acts as the merchant of record (the authorized reseller and seller of record) for your purchase. This means Dodo Payments runs the checkout, charges your payment method, handles applicable taxes and VAT, and manages billing on our behalf. Your purchase is also subject to Dodo Payments' own terms and policies presented at checkout. We do not store your full payment card details.
Auto-renewal. Subscriptions renew automatically. By subscribing, you authorize Dodo Payments to charge your chosen payment method, on a recurring basis, the then-current subscription fee plus applicable taxes at the start of each billing period (monthly or annual, depending on your plan), until you cancel. Your subscription will continue and renew automatically unless and until you cancel it as described in Section 8 or it is otherwise terminated.
If a payment fails, we or Dodo Payments may retry the charge and may suspend or downgrade your access until payment is successfully made. You are responsible for keeping your payment method valid and up to date.
7. Price changes
We may change the price of the Service and the features included from time to time. Any price change applies to purchases made after the change takes effect; it does not affect access you have already paid for.
8. Lifetime access
Your purchase is a one-time payment that grants lifetime access to the Content. There is no recurring billing and nothing to cancel. If you have a question, contact us via our contact page.
For refunds, see Section 9 below.
9. Refunds
The Service provides immediate access to the Content upon purchase. All sales are final and we do not offer refunds, except where a refund is required by applicable law. By purchasing, you request immediate access to the digital Content and acknowledge that this is why it is non-refundable. For full details, see our Refund Policy, which forms part of these Terms.
10. Acceptable use and prohibited conduct
The Content is the result of significant original effort, and your license is personal and limited. You agree that you will not, and will not permit or assist anyone else to:
- Scrape, crawl, harvest, index, spider or use any automated means, bot or script to access, read or collect Content from the Service;
- Bulk download, copy, export, archive or store the library or any substantial portion of the Content;
- Reproduce, republish, distribute, broadcast, display, sell, license, sublicense or otherwise make the Content available to any third party, whether for free or for a fee;
- Resell, sublicense or commercially exploit access to the Service, or use it to build, train or populate a competing or substantially similar product, dataset or AI model;
- Share your Account, credentials or sign-in link, or allow more than one person to use a single Account;
- Circumvent, disable or interfere with any access controls, paywall, rate limits or security or authentication measures;
- Access the Service through any interface other than the one we provide, or attempt to gain unauthorized access to any part of the Service, accounts, systems or networks;
- Reverse engineer, decompile or disassemble any part of the Service, except to the limited extent applicable law expressly permits;
- Introduce malware or any harmful code, or take any action that imposes an unreasonable or disproportionately large load on our infrastructure;
- Remove, obscure or alter any copyright, trademark or other proprietary notices;
- Use the Service for any unlawful, infringing, fraudulent or deceptive purpose, or in violation of these Terms or any applicable law.
We reserve the right to monitor use of the Service for compliance and to investigate and take appropriate action against anyone who, in our sole discretion, violates this Section, including removing access, suspending or terminating Accounts, and pursuing legal remedies.
11. Intellectual property
The Service and the Content are protected by copyright, database rights, trademark and other intellectual property laws. As between you and us, we own or license all rights, title and interest in and to the Service, including our original write-ups, the selection, arrangement, categorization and compilation of the library, the software, design, branding and the "HowTheyGotUsers" name and logo. Our compilation and our original summaries are proprietary to us.
The underlying user-acquisition tactics themselves are facts and ideas about what real founders did, and facts and ideas are not owned by anyone. We do not claim ownership of the underlying tactics, of the public interviews, podcasts or articles in which they were discussed, or of any third-party source we link to. Each Tactic links out to a public source that we do not own or control. We do not host or reproduce third-party copyrighted text; we provide our own original summaries together with links to the public sources.
Except for the limited license expressly granted in Section 4, nothing in these Terms transfers any intellectual property rights to you. All rights not expressly granted are reserved.
12. Third-party links and sources disclaimer
The Service contains links to third-party websites, interviews, podcasts, articles and other materials that we do not own, operate or control. These links are provided for reference and convenience only. We are not responsible for the availability, accuracy, content, products, services or practices of any third-party source, and a link does not imply our endorsement of, or affiliation with, that source. Third-party sources may change, move or disappear over time, and we cannot guarantee that any linked source will remain available. Your use of any third-party website or material is at your own risk and subject to that third party's own terms and policies.
13. No guarantee of results; not professional advice
The Content is provided for general educational and informational purposes only. It describes tactics that other founders have reportedly used; it is not a promise, guarantee or prediction that any tactic will work for you or produce any particular result. Markets, channels, platforms and audiences differ, and outcomes depend on many factors outside our control.
Nothing in the Service constitutes professional, legal, financial, tax, investment, accounting or business advice, and it should not be relied upon as a substitute for advice from a qualified professional who is familiar with your specific situation. You are solely responsible for evaluating, and for the consequences of, any tactic, decision or action you take based on the Content. Before acting on any tactic, you are responsible for ensuring that it complies with all laws, regulations and platform terms applicable to you.
14. Feedback
If you choose to send us feedback, suggestions, ideas or other input about the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable and transferable license to use, reproduce, modify and exploit that Feedback for any purpose, without any obligation, attribution or compensation to you. Feedback is provided voluntarily and is not confidential.
15. Privacy
We respect your privacy. We store only the information needed to operate the Service, which is your email address and your purchase status; we do not store passwords. Our use of your information is described in our Privacy Policy, which explains what we collect, how we use it, and the sub-processors we rely on, including Vercel (hosting), Supabase (authentication and identity), Dodo Payments (payments and merchant of record) and Resend (transactional email). By using the Service you acknowledge our Privacy Policy.
16. Disclaimers; "AS IS"
To the maximum extent permitted by applicable law, the Service and all Content are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied or statutory. We expressly disclaim all implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, error-free or available at any particular time or location, that defects will be corrected, that the Content is complete, accurate, current or reliable, or that any tactic or source described will achieve any result. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you; in that case, such warranties are limited to the minimum scope and duration permitted by law.
17. Limitation of liability
To the maximum extent permitted by applicable law, in no event will HowTheyGotUsers or its operator, suppliers or licensors be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunities or anticipated savings, arising out of or relating to your use of, or inability to use, the Service or Content, whether based in contract, tort (including negligence), strict liability or any other legal theory, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the total amount of fees you actually paid to us (or to Dodo Payments for the Service) in the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud. Where applicable law does not allow the exclusion or limitation of certain damages, the above limitations apply only to the extent permitted.
18. Indemnification
You agree to indemnify, defend and hold harmless HowTheyGotUsers and its operator, contractors, suppliers and licensors from and against any claims, demands, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service or Content; (b) your breach of these Terms; (c) your violation of any law or of the rights of any third party; or (d) any content or action you submit, post or take through the Service. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us.
19. Termination and suspension
You may stop using the Service at any time as described in Section 8. We may suspend or terminate your access to the Service, in whole or in part, with or without notice, if we reasonably believe that you have breached these Terms, that your use poses a security or legal risk, that we are required to do so by law, or in order to protect the Service, other users or third parties. Where reasonable and lawful to do so, we will try to provide notice.
Upon termination, your license and right to access the Service will immediately end. If we terminate your access for your breach of these Terms, you will not be entitled to any refund. Sections that by their nature should survive termination, including Sections 9 through 24, will survive.
20. Changes to the Service and to these Terms
We are continually improving the Service and may add, change, suspend or discontinue features, content or the Service as a whole at any time. We may also update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as posting the updated Terms with a new "Last updated" date or sending notice to your Account email. Changes take effect when posted unless stated otherwise. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
21. Force majeure
We will not be liable or responsible for any failure or delay in performing our obligations under these Terms that is caused by events or circumstances beyond our reasonable control, including acts of God, natural disasters, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, government action, labor disputes, power or internet failures, or the failure, interruption or unavailability of third-party services, hosting, payment processors or telecommunications.
22. Governing law and dispute resolution
These Terms and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of [Governing law jurisdiction], without regard to its conflict-of-laws rules. You and we agree that the courts located in [Governing law jurisdiction] will have exclusive jurisdiction to resolve any dispute, except that we may seek injunctive or equitable relief in any competent court to protect our intellectual property or the security of the Service.
Before filing any formal claim, you agree to first contact us via our contact page and attempt to resolve the dispute informally in good faith. Nothing in this Section deprives consumers of any mandatory protections or rights to bring proceedings in their country of residence that cannot be waived under applicable law.
23. Severability
If any provision of these Terms is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or, if it cannot be so modified, severed from these Terms, and the remaining provisions will continue in full force and effect.
24. Entire agreement; miscellaneous
These Terms, together with the Privacy Policy and the Refund Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior or contemporaneous understandings or agreements on the subject. Our failure to enforce any provision is not a waiver of that provision. You may not assign or transfer these Terms or your Account without our prior written consent; we may assign these Terms in connection with a merger, acquisition, reorganization or sale of assets. There are no third-party beneficiaries to these Terms. Headings are for convenience only and do not affect interpretation.
